Terms of Service

1. Agreement to These Terms

These Terms of Service govern your access to and use of Ace FollowUps. By creating an account, subscribing, or using the service, you agree to these Terms and the Ace FollowUps Privacy Policy. If you do not agree, do not use the service.

Ace FollowUps is intended for businesses. You represent that you have authority to use the service for the business or organization you represent.

2. The Service

Ace FollowUps is a SaaS tool that helps businesses manage customers, follow-ups, customer history, receipts, and related business records. Pro includes automated scheduled email follow-ups through a connected Google/Gmail account.

SMS or text-message automation is not currently included in Pro. Pro Plus is coming soon and is not currently available for purchase. We may modify, improve, limit, suspend, or discontinue parts of the service as the product develops, subject to applicable law.

3. Accounts and Security

You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, and all activity under your account. Do not share access in a way that compromises account security.

Notify Ace FollowUps promptly if you believe your account or credentials have been compromised. We may take reasonable steps to protect the service and its users, including limiting or suspending access where we reasonably believe there is a security, legal, or abuse concern.

4. Subscription, Trial, and Billing

Ace FollowUps Pro costs $19.99 per month. New eligible subscriptions receive a 3-day free trial. A valid payment method or card is required to start the trial.

Unless you cancel before the trial ends, the trial automatically converts to the paid $19.99/month Pro subscription and the payment method is charged. Subscriptions automatically renew monthly until canceled. Applicable fees and billing details are disclosed during checkout, and payments are processed by Stripe.

You may cancel through the available subscription or billing management functionality. If cancellation is scheduled for the end of the current trial or billing period, access may continue through that period. Any refund or credit is subject to the terms presented through the applicable billing process; these Terms do not create a separate refund guarantee.

5. Google and Gmail

You may connect a Google/Gmail account so Ace FollowUps can send scheduled follow-up emails on your behalf. Ace requires the Gmail sending permission necessary for this functionality. Google access and your use of Gmail remain subject to Google's applicable terms and policies.

You are responsible for ensuring that you have the right and permission to contact the recipients you add to Ace FollowUps. You must comply with applicable anti-spam, privacy, marketing, and communications laws. Disconnecting Gmail or revoking access may prevent automated follow-up emails from being sent.

6. Customer Data and Communications

You are responsible for the accuracy, legality, and appropriate use of customer and contact information entered into Ace FollowUps. You must have the authority and any required permission to upload, store, process, and contact the people whose information you enter.

You remain responsible for reviewing follow-up schedules, recipient details, message content, customer history, receipts, and other records before relying on them. You are responsible for your communications with customers and for responding appropriately to customer requests or replies. 7. Acceptable Use

You may not use Ace FollowUps to violate any law or regulation; send spam, phishing, fraud, harassment, impersonation, unlawful bulk messages, or other abusive communications; distribute malware; gain unauthorized access to accounts or systems; abuse Google or Gmail permissions; infringe another person's rights; or use customer data without appropriate authorization.

You may not interfere with the service, evade access or usage limits, reverse engineer it except where applicable law permits, or use it to develop a competing service through unauthorized means.

8. Automation and Availability

Automated follow-up emails depend on third-party services, internet availability, Google/Gmail availability, account permissions, correct settings, and other technical factors. Ace FollowUps does not guarantee uninterrupted service, error-free operation, or delivery of every email.

The service is provided subject to availability. We may perform maintenance, make changes, or temporarily suspend features when reasonably necessary for operation, security, compliance, or product development.

9. Intellectual Property

Ace FollowUps and its software, branding, interface, original website content, and related materials are owned by or used by Ace FollowUps and are protected by applicable intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service for your business while your account is authorized.

You retain your rights in your own customer data, business records, content, and materials. You grant Ace FollowUps the limited rights necessary to host, process, transmit, and display that information to provide the service and perform the actions you request.

10. Third-Party Services

Ace FollowUps relies on third-party services including Supabase for authentication and application data, Stripe for subscription and payment processing, and Google/Gmail for connected email functionality. Third-party services may have their own terms, policies, outages, and limitations. Ace FollowUps is not responsible for third-party services to the extent permitted by law.

11. Disclaimers

To the extent permitted by law, Ace FollowUps is provided on an as-available basis without warranties that the service will be uninterrupted, error-free, secure, or suitable for every business purpose. We do not guarantee that every scheduled email will be sent or delivered, that a customer will receive or respond to a message, or that the service will meet a particular result.

You are responsible for your account, customer data, communications, legal compliance, Gmail permissions, and decisions made using the service.

12. Limitation of Liability

To the extent permitted by law, Ace FollowUps and the people and service providers involved in operating it will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the service or these Terms.

To the extent permitted by law, the total liability for claims related to the service will not exceed the amount you paid to Ace FollowUps for the service during the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot legally be limited.

13. Suspension and Termination

You may stop using the service or cancel your subscription through the available billing controls. We may suspend or terminate access if you violate these Terms, create a security or legal risk, fail to pay applicable fees, or as reasonably necessary to protect the service and its users. Provisions that by their nature should continue, including ownership, disclaimers, limitations of liability, and payment obligations, will continue after access ends.

14. Governing Law

These Terms do not currently designate a specific legal entity, physical address, governing-law jurisdiction, or dispute forum. Those details should be confirmed through legal review before commercial launch. Until then, disputes will be handled under applicable law and in an appropriate forum as determined by applicable legal requirements.

15. Changes to These Terms

We may update these Terms as the service or business changes. We will post updated Terms on this page and update the effective date. Your continued use of Ace FollowUps after an update means you accept the updated Terms.
